Protecting your claim after a car accident

The actions you take after a car accident can greatly affect your insurance claim and the amount of payout that you receive, even if you are clearly not at fault in the accident and suffer serious injuries as a result of it.

Insurance providers offer coverage to drivers to protect against the possibility of an accident, which is a needed service. However, these companies seek to make profits wherever they can, and often this comes at the expense of their own clients or the claimants against their clients. If an insurance company can identify ways to reduce its payout and stay within the guidelines of the law (usually), then it most likely will do so.

In many instances, attempting to navigate the insurance claim resolution process by yourself while also facing your own physical recovery from an injury compromises both efforts. Fortunately, while no one can do the work of physical recovery for you, an attorney can represent you in your dealings with an insurance company. As your legal representative, your attorney will ensure that you receive the full compensation that you deserve while protecting your rights and interests.

Proper documentation is key

In order to file a successful claim, it is wise to provide detailed documentation of every aspect of the accident and your resulting injuries and material losses. This applies to both the damages and evidence associated with the claim that may prove your innocence in the accident. Much like business expenses, keep receipts of any related costs that you incur while attempting to resolve the matter for future reimbursement.

It is also very important to understand your own coverage in detail before you give your own insurer a statement about the accident. You may have less coverage than you expect, or the details of your accident may fall within a coverage "grey area" that may or may not get covered properly if you do not know what you deserve and can expect.

Don't accept an offer without careful consideration

Whether from your own provider or from the insurance provider of another driver, it is never wise to accept an initial or even subsequent offers of settlement without careful scrutiny. You should not assume that your own provider, for instance, cannot make a better offer before you review the terms and compare them to your actual losses and the ongoing cost of your injuries.

Apart from your immediate medical expenses, you may have a long road to recovery ahead of you, and it is unwise to assume that your injuries will heal without complication.

You may choose to address your claim any number of ways, depending your own priorities. Be sure that you understand all sides of your claim and any offers you may accept as you work toward recovery.
